What tasks does a legal guardian have?
Legal guardians look after the interests of people who are unable to make important decisions for themselves due to their age, illness, disability or mental limitations.
On behalf of the guardianship court, this is the task of providing legal care for people of legal age: In addition to dealing with official matters, submitting applications and processing the personal mail of the people receiving care, it can also involve organising care or dealing with health and financial matters, for example.
What requirements does a legal guardian need to fulfill?
Legal knowledge, in particular social and care law, is a prerequisite for working as a professional legal guardian, along with business knowledge and professional experience in working with mentally ill, mentally disabled and mentally handicapped people.
Before taking up this activity, registration by the local care authority of the district is required. The prerequisites for this are personal suitability and reliability, professional liability insurance cover and sufficient expertise.
A degree is not required, but a willingness to attend training courses for the task is necessary. Anyone who has successfully completed a degree in social pedagogy or social work or is qualified to hold judicial office belongs to the privileged group of people and does not have to prove any additional expertise, as this has already been acquired through their studies. Registration by the local district care authority and commencement of work as a professional legal guardian can therefore take place quickly.
Professional legal guardians work on a freelance basis and receive a flat-rate fee. There are no specific professional requirements for working as a volunteer legal guardian. Voluntary legal guardians can receive an annual expense allowance. Both work as a professional legal guardian and as a volunteer legal guardian can be carried out on a part-time basis.
